The Education Flexibility Partnership Act of 1999 provides all states that have specific accountability safeguards with the opportunity to participate in the new Ed-Flex program. The eligibility criteria are that a state must:

1. Have approved content and performance standards and an aligned assessment system as required under Title I
2. Have an approved accountability system under Title I

3. Have the authority to waive state education requirements
