Loan Issues

Second Meeting
February 18-19, 1999

This meeting commenced at approximately 8:30 a.m. on February 18, 1999, and adjourned on February 19, 1999, at approximately 3:00 p.m.

All members, except United States Student Association; and the facilitators were present. The meeting summary of the Team's first meeting was distributed and approved without revision.

The Department of Education distributed documents which included some draft language for certain "category 2" items to be included in the NPRM to be negotiated and some outlines highlighting features of certain "category 3" items. These were reviewed and discussed by the Team.

The following draft provisions were the subject of tentative agreements:

685.400; 685.401; and 685.402 (school eligibility criteria)

(The Team agreed that the Department could issue a NPRM respecting these Direct Loan provisions.)

Many other provisions were discussed and in some cases suggestions for redrafting indicated that tentative agreements should be forthcoming.

Other Team members also distributed draft provisions and discussion papers. These included, "Legal Services Team Proposals - Unpaid Refunds Discharge;" "Proposal for Institutional Certification of Corrected Cohort Default Data," distributed by NASULGC; "Negotiated Rulemaking Issues - Committee II - Loan Issues" distributed by AACS; and a packet covering numerous provisions under consideration, prepared by a group of members with particular interest in FFEL.

The Department of Education stated that a "Dear Colleague" letter entitled "Approval of the Master Promissory Note in the Federal Family Education Loan (FFEL) Program for Academic Year 1999-2000" had issued.

The Team discussed selected "category 3" items identified by the Department of Education to determine whether the Department understood the other members' points of view and to elicit more discussion where that appeared appropriate.

Finally, the Department indicated that it will do its best to provide as much draft material to the other members well in advance of the Team's third meeting as it can. If it can, the Department may also issue, even earlier, a document indicating "target topics" to assist the others' preparations.

The Team's third meeting is scheduled for March 24 (1:00 p.m.), 25 and 26, 1999.
