V. Primary Delegations of Authority

The Secretary has delegated the following authorities to the Assistant Secretary for Management subject to certain reservations:

  • All administrative and management functions for ED, including:
    • Human resources;
    • Strategic planning;
    • Management planning and analysis;
    • Organizational approval;
    • Delegations of Authority;
    • Facilities engineering;
    • Surplus property;
    • Administrative budget; and
    • Administrative services.
  • Authority to administer the Federal Real Property Assistance Program pursuant to Section 484 (k) of the Federal Property and Administrative Services Act of 1949, as amended (40 U.S.C. 484 (k).
  • Authority to administer the Equal Employment Opportunity Program in the Department in accordance with Title VII of the Civil Rights Act of 1974, 42 U.S.C. 2000 et seq., as amended; the Rehabilitation Act of 1973, 29 U.S.C. 701 et seq., as amended; the Age Discrimination in Employment Act of 1978, 29 U.S.C. 621 et seq., as amended, and the Equal Pay Act of 1963, 29 U.S.C. 206(d). Also, the authority for enforcement of nondiscrimination on the basis of disability in programs and activities conducted by the Department in compliance with 29 U.S.C. 794 and 34 C.F.R. Part 105, including the authority for making determinations in appeals under 34 C.F.R. Part 105.
  • Authority to administer the Department's Safety and Health Program in accordance with 29 C.F.R. 1960 (1984) and serve as the Department's Designated Agency Safety and Health Official.
  • Authority to exercise full collective bargaining authority.
  • Authority as designated official for ensuring compliance with Executive Order 12630 (Governmental Actions and Interference with Constitutionally Protected Private Property).
  • Authority to perform as Garnishment Agent for non-commercial and commercial garnishments under 5 C.F.R. Parts 581 and 582, and the authority to process bankruptcy orders served upon the Department in accordance with Title 11 of the Unites States Code.
  • Authority to administer the Freedom of Information Act, as amended, 5 U.S.C. 552, including appeals, and the Privacy Act, 5 U.S.C. 552a.
  • Authority for the Department of Education's Personnel Security and Suitability Programs.
  • Authority for the Classified National Security Program.
