In order to resolve the allegation in the above-referenced complaint filed with the U.S. Department of Education, Office for Civil Rights (OCR), under Section 504 of the Rehabilitation Act of 1973, as amended, 29 U.S.C. Section 794 and its implementing regulations at 34 C.F.R. Part 104, and Title II of the Americans with Disabilities Act, 42 U.S.C. 12131 and 28 C.F.R. Part 35 and its implementing regulations at 28 C.F.R. Part 35, the Adair County School District (the District) voluntarily commits to implement the provisions set forth in this Resolution Agreement (Agreement). This Agreement does not constitute an admission by the District that any violation of Section 504, Title II or their implementing regulations has occurred.

The District agrees to take the following actions:

REPORTING REQUIREMENTS

  1. By March 15, 2014, the District will submit this plan to OCR for its review and approval. The District agrees that it will consult with OCR regarding this plan and implement any additional recommendations made by OCR as necessary to ensure compliance with XXXXX or XXXXX XXXXXXX XX XXXXX. XXX XXX XXXX XX XXXX XXXXXX XXX XXXXXXXXXX XX XXXXXXXXXXXXX XX XXXXXXX XXX XXXXXXXX XXXXXXXXXX XXX XXXXXX.


  2. The District agrees to comply with the terms of this Agreement until OCR has released it from monitoring. OCR will not close the monitoring until it determines that the District has fulfilled the terms of this Agreement and is in compliance with the provisions of Section 504 and Title II, which are applicable to this complaint.

The District understands that by signing this Agreement, it agrees to provide data and other information in a timely manner in accordance with the reporting requirements of this Agreement. Further, the District understands that during the monitoring of this Agreement, OCR may visit the District, interview staff and students and request such additional reports or data as are necessary for OCR to determine whether the District has complied with the terms of this Agreement and the provisions of Section 504 and Title II.

The District understands and acknowledges that OCR may initiate administrative enforcement or judicial proceedings to enforce the specific terms and obligations of this Agreement.  Before initiating administrative enforcement (34 C.F.R. §§ 100.9, 100.10), or judicial proceedings to enforce this Agreement, OCR shall give the District written notice of the alleged breach and a minimum of sixty (60) calendar days to cure the alleged breach.
