Title IX: Intercollegiate Athletics: Southeastern Louisiana University (SELU) (06-10-6001)

On March 14, 2014, OCR Dallas resolved its Title IX compliance review with Southeastern Louisiana University (SELU or University) with a Resolution Agreement.   The review examined whether the University awards athletics scholarships or grants-in-aid in a nondiscriminatory manner and provides male and female students an equal opportunity to participate in the University’s intercollegiate athletic programs. OCR’s review also examined whether SELU provided equal athletic opportunities for male and female students with regard to benefits and services in the University’s intercollegiate athletics program.  Prior to OCR concluding its investigation and making a compliance determination, the University expressed an interest in resolving the compliance issues identified during the course of the investigation.  The Agreement requires SELU to demonstrate that equal opportunities were provided in awarding athletic scholarships to male and female athletes during the 2014-2015 academic year.  If the University is unable to demonstrate current compliance with Title IX, it must then submit a detailed plan to ensure that, by the beginning of the 2015-2016 academic year, the University is in full compliance with its Title IX obligation to provide athletic scholarships in a nondiscriminatory manner and document the interim steps taken during the 2014-2015 academic year to meet its Title IX obligation. The Agreement also requires the University to demonstrate that it is effectively accommodating the athletic interests and abilities of both sexes in order to provide them an equal opportunity to participate in sports, or if unable to demonstrate current compliance, the University will submit a detailed plan to OCR as to the specific actions the University will take to achieve future compliance by the 2015-2016 academic year, including the interim steps the University will take during the 2013-2014 and 2014-2015 academic years to increase athletic participation opportunities for female students.  In addition, the Agreement requires SELU to address several deficiencies regarding the practice and competitive facility for the women’s soccer team and to conduct a comprehensive assessment of all locker rooms, practice and competitive fields and facilities for men’s and women’s athletics teams to ensure the equivalent provision of locker rooms and practice and competitive facilities.  If SELU determines that the men’s and women’s athletic teams are not receiving comparable benefits and opportunities with respect to locker rooms, practice fields and facilities, and competitive fields and facilities, SELU will develop a plan to ensure that male and female student athletes are provided equivalent benefits and services in this area.
